You grant MYJOYPIN a non-exclusive, royalty-free license to store, display, use, reproduce, and distribute your uploaded and published content across various media and formats. Additionally, you authorize others to similarly store, display, use, reproduce, and distribute your content across all media and formats.
To the extent allowed by applicable law, MYJOYPIN assumes no liability for user-generated content or any claims, damages, or expenses resulting from the use or publication of materials through its Service. MYJOYPIN reserves the right to remove any content deemed inappropriate, offensive, or in violation of these Terms.
This Agreement becomes effective on the date it is initially accepted.
Age restriction

Additionally, we may suspend or terminate your account, with or without prior notice, if we believe that any activity associated with that account constitutes or may constitute a breach of these Terms and Conditions, an infringement of third-party rights, or a violation of applicable laws or regulations. We reserve all rights to terminate accounts, modify or remove content, and cancel orders at our sole discretion.
You may have several accounts with different login options, such as email, Google account, or crypto wallet. However, please avoid misusing this flexibility by creating multiple accounts unnecessarily, as it may be flagged as fraudulent activity and could result in your account being blocked or closed.

Once an account is closed, all associated data is automatically and permanently deleted from our servers, either immediately or within the month following the request.

Any and all Content submitted by you is owned and controlled solely by you, and not by MYJOYPIN.
MYJOYPIN does not claim any ownership rights in your Content and your Content remains your sole responsibility.
As a passive platform, MYJOYPIN stores and facilitates the distribution of content under the direction and authorization of its users. MYJOYPIN neither oversees nor has knowledge of the content uploaded, nor does it exert any control over it. Users are solely accountable for all content they submit, publish, or distribute through the Service. To the maximum extent permitted by law, MYJOYPIN disclaims liability for all user-generated content, including your own, and any user activities related to this content.
MYJOYPIN does not review user-submitted content, nor does it, along with its subsidiaries, affiliates, successors, assigns, employees, representatives, directors, officers, or shareholders, have any obligation to monitor the Service.
Links to the Service must not appear on any website that could be deemed defamatory, obscene, criminal, or infringing upon third-party rights.
MYJOYPIN, along with its subsidiaries, affiliates, successors, assigns, employees, representatives, directors, officers, and shareholders, disclaims all liability to the fullest extent permitted by law for user-submitted content. Once linked, we may access and store content from your Third-Party Accounts (“Social Network Content”), such as email and profile picture, and exchange additional information as notified. Note that your relationship with third-party providers is governed solely by your agreements with them. We don’t review or take responsibility for Social Network Content. You can deactivate the connection and request deletion of stored data.
Intellectual property
You acknowledge that all materials, products, and services provided on this website or through the Service - excluding content that is created, submitted, or generated by users - are the exclusive property of MYJOYPIN and its affiliates, directors, officers, employees, agents, suppliers, or licensors. This ownership encompasses all copyrights, trade secrets, trademarks, patents, and other forms of intellectual property. Reporting violations

After Submitting a Takedown Notice. Once your Takedown Notice meets the stated requirements, here’s what happens next:

Refund Policy

Once an account is closed, all associated data is automatically and permanently deleted from our servers, either immediately or within the month following the request.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOT WITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING OR ONE HUNDRED (100) EUR.
To the fullest extent allowed by law: (a) You bear full responsibility for any damages, claims, costs, or expenses (including, but not limited to, legal fees) arising from third-party claims linked to your use of the Service. (b) You are solely liable for any indirect, special, incidental, punitive, or consequential damages resulting from or connected to your use of the Service. (c) The Company’s total liability, in aggregate, arising from or related to your use of the Service, is capped at €100 (EUR one hundred), irrespective of the cause.
MYJOYPIN, along with its subsidiaries, affiliates, successors, assigns, and their respective employees, representatives, directors, officers, and shareholders, will not be held liable for:
Losses or Damages Resulting From: (a) Your inability to access or use the platform, its parts, content, or any external service via the platform. (b) Changes made to the platform, temporary or permanent suspension, or interruptions affecting access to content across any or all regions. (c) Actions taken against you by third-party rights holders related to alleged infringements involving your content or platform use, or investigations conducted by MYJOYPIN or relevant authorities. (d) Technical errors, inaccuracies, omissions, or defects in the Service or its content. (e) Providing inaccurate or incomplete information to MYJOYPIN, or failing to maintain confidentiality regarding your account data, username or password. (f) Misconduct by other users or third parties on the platform, especially if in breach of the agreement.
Loss or Damage to Technology or Data: Any harm to your computer hardware, software, or data (including your content), or losses resulting from a security breach.
Unforeseeable Losses or Damages: Any loss of profits or non-foreseeable losses, such as missed opportunities. Foreseeable losses are defined as those anticipated by you and MYJOYPIN at the time this agreement was made.
Claims Notification. You must notify MYJOYPIN as soon as possible regarding any claims or legal issues arising from your use of the platform.
Limitations by Law. Certain jurisdictions may not permit the exclusion or limitation of liability for incidental or consequential damages. In such cases, these exclusions or limitations will apply only to the fullest extent permitted by law. You agree that this represents a fair and reasonable allocation of risk between you and MYJOYPIN.
Exclusions of Liability. Nothing in this agreement limits or excludes MYJOYPIN, its subsidiaries, successors, assigns, or their representatives from liability for: (a) Death or personal injury caused by negligence. (b) Fraud or intentional deception. (c) Damage caused by gross negligence or intentional actions. (d) Any liability that cannot be excluded or limited under applicable law.
Applicable Law and Jurisdiction
Unless otherwise required by mandatory law within any European Union member state: (a) This Agreement is governed by the laws of the Republic of Portugal, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and principles of conflict of laws (private international law). (b) Both you and MYJOYPIN agree to submit to the exclusive jurisdiction of the courts of Aveiro, Portugal, to resolve any disputes, actions, or proceedings arising from this Agreement.
The above provisions regarding governing law and jurisdiction do not apply to proceedings in which MYJOYPIN seeks equitable relief. In the event of a breach of this Agreement by MYJOYPIN or a third party, you acknowledge that any resulting damages or losses will not entitle you to seek injunctive or equitable relief against MYJOYPIN, including in relation to your Content. Your sole remedy will be monetary damages, subject to the liability limitations outlined in these Terms and Conditions.
Dispute resolution. To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms and Conditions (each a ‘Dispute’ and collectively, the ‘Disputes’) brought by either you or us (individually, a ‘Party’ and collectively, the ‘Parties’), the Parties agree to first attempt to negotiate any Dispute informally for at least 30 (thirty) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. The seat of arbitration shall be Aveiro, Portugal. The language of the proceedings shall be English. Applicable rules of substantive law shall be the law of Portugal.
Indemnification
You agree to indemnify and hold MYJOYPIN and its affiliates harmless from any legal claims, demands, or liabilities arising from your use or misuse of our services. MYJOYPIN reserves the right to select its own legal counsel to handle such claims.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your Content; (2) use of the Services; (3) breach of these Legal Terms; (4) any breach of your representations and warranties set forth in these Legal Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any overt harmful act toward any other user of the Services with whom you connected via the Services. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
